Revocation of life and pension insurances

Life and pen­sion in­sur­ance con­tracts con­cluded be­fore Decem­ber 31st, 2007 can still be re­versed by ob­jec­tionif the can­cel­la­tion policy was either not is­sued or if it was in­cor­rect. The Ger­man Fed­eral Court of Justice (BGH) con­firmed the pos­sib­il­ity of re­voc­a­tion in its cur­rent case-​law with ref­er­ence to a judg­ment of the European Court of Justice (EuGH). There­fore the in­sur­ance is ob­liged to re­turn the paid premi­ums as well as the in­terest rate re­lated to these pay­ments, after a revocation.
